Acceptance of terms

These Terms are a binding agreement between you and Essel ("we", "us"). By creating an account or using essel.ai, the dashboard, our tools, or our APIs (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you use Essel on behalf of an organization, you confirm you have authority to bind that organization.

What Essel does

Essel is an autonomous AI SEO content engine. It researches topics, drafts and optimizes articles for search and AI answer engines, scores quality, and publishes to the platforms you connect, on a cadence you control. The Service is provided as software; you remain responsible for reviewing output and deciding what to publish.

Your account

  • You must provide accurate information and keep your credentials secure.
  • You are responsible for all activity that happens under your account.
  • You must be at least 16 years old, or the age of majority where you live, to use Essel.
  • Notify us immediately if you suspect unauthorized access to your account.

Acceptable use

You agree not to use Essel to:

  • Generate or publish content that is unlawful, defamatory, infringing, or deceptive, including spam or content designed to manipulate search rankings in violation of a platform's guidelines.
  • Violate the rights of others or the terms of any platform you connect.
  • Reverse engineer, scrape, or overload the Service, or bypass its rate limits and security controls.
  • Resell or sublicense the Service without our written permission.
  • Upload malware or attempt to gain unauthorized access to our systems or other users' data.

You are responsible for ensuring the content you publish complies with applicable laws and the rules of the platforms you publish to. We may suspend accounts that violate this section.

Content and ownership

You own the content you create with Essel. As between you and us, you retain all rights to the inputs you provide and the drafts and articles the Service produces for you. You are responsible for the content you publish.

You grant us a limited license to process your content solely to operate the Service for you, for example to generate drafts, score quality, and publish to your connected platforms. We claim no ownership of your content and do not use your private workspace content to train foundation models.

Because the Service relies on generative AI, output may be similar to content generated for other users and is not guaranteed to be unique, accurate, or free of third-party rights. Review output before you publish it.

Third-party integrations

When you connect a platform such as WordPress, Webflow, or Ghost, you authorize Essel to take the actions you request on your behalf, like creating and updating posts. Your use of those platforms is governed by their own terms, and we are not responsible for their availability or behavior. You can disconnect any integration at any time.

Plans and billing

  • Paid plans are billed in advance on a recurring basis through our payment processor.
  • Fees are non-refundable except where required by law or expressly stated in your plan.
  • We may change pricing with reasonable notice; changes apply to the next billing cycle.
  • You can cancel at any time; access continues until the end of the paid period.
  • If a payment fails, we may suspend or downgrade your account until it is resolved.

Our intellectual property

Essel, including its software, design, and trademarks, belongs to us and our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service. They do not transfer any of our intellectual property to you.

Suspension and termination

You can stop using Essel and close your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that creates risk for us or others. On termination, your right to use the Service ends; we will make your content available for export for a reasonable period unless the law requires otherwise.

Disclaimers

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not guarantee specific search rankings, traffic, or business outcomes. SEO results depend on factors outside our control, including search engine and platform behavior. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, Essel is not liable for indirect, incidental, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to defend and indemnify Essel against claims, losses, and expenses arising from your use of the Service, your content, or your violation of these Terms or the rights of others.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction of the courts located in India, unless mandatory law in your country requires otherwise.

Changes to these terms

We may update these Terms as the product changes. When changes are material, we will update the date above and notify you in-app or by email. Continuing to use the Service after an update means you accept the revised Terms.
